Germany's Federal Court of Justice has struck down the price increase Amazon applied to Prime in 2022, and customers can claim their money back. tagesschau.de, ComputerBase and WinFuture all report the ruling. Amazon has lost at the top of Germany's civil court system.

Was bekannt ist

The case covered the Prime fee increase Amazon introduced in Germany in 2022. According to the reports, the Federal Court of Justice (Bundesgerichtshof, or BGH) did not uphold the increase. It stopped it.

That gives subscribers a claim. Anyone who paid the higher fee after the increase can ask Amazon to return the difference.

All three reports agree on the core points. Amazon lost, the 2022 increase does not stand, and Prime members have claims against the company.

Einordnung

Prime is a recurring subscription. When a price increase falls, the effect is not limited to one month. It reaches every billing period since the new price took effect. The longer someone stayed a member, the more payments they made at the higher rate.

The BGH is the final instance in German civil law, so the case has no further appeal within that system. That gives the decision weight beyond this one dispute. It goes to the question of when subscription services may change prices in the middle of a running contract. The question is not specific to Amazon. It applies to any service billed monthly or yearly.

For Prime members, the first step is their own payment history. If you want to reclaim money, pull up your billing records from 2022 onward. They show which fee was charged and when, and how long you actually paid the higher price. Any claim will rest on those records, no matter how it is eventually filed.

Was offen ist

The exact difference per plan has not been confirmed so far. It is also unclear whether Amazon will refund members on its own or whether customers have to act, and which deadlines apply. Another open point is whether people who joined after the increase have any claim.
